1. NO PURCHASE NECESSARY. YOU MUST BE 18 YEARS OF AGE OR OLDER AND A LEGAL RESIDENT OF THE 48 CONTIGUOUS UNITED STATES (EXCLUDING ALASKA AND HAWAII) TO ENTER. VOID WHERE PROHIBITED. To enter the “Mow Less, Catch More BigFish” Exmark Summer Sweepstakes upload a photo to BerkleyBigFish.com between June 1 and August 31 and check the appropriate checkbox to enter the photo in the Summer Sweepstakes. Each photo uploaded to the site between June 1 and August 30 is considered a separate entry. Enter as often as you wish, but each entry must contain a different JPG photograph and have attached Catch Information and/or a BigFish Story. No mass/automated entries or digitally altered photographs will be accepted. BerkleyBigFish retains the rite to delete any and all photos submitted to the competition for any reason. BerkleyBigFish is not responsible for lost, late, incomplete, misdirected or incompatible files. By entering this Competition, entrants accept and agree to be bound by these Official Rules and the decisions of the judges, which shall be final, binding and conclusive on all matters. Entries become the exclusive property of Sponsor. All entrants are subject to the terms and conditions that govern BerkleyBigFish.com. Competition starts 06/01/08 and ends 8/31/08.
2. PRIZE/ODDS: GRAND PRIZE: One Grand Prize winner will be awarded a new Exmark Quest Zero Turn Mower. Grand Prize winner will be responsible for pickup of their new mower at their nearest Exmark distributor. No substitutions permitted except at the sole discretion of Sponsor, in which case a prize of greater or equal value will be awarded. Sponsor will report value of prize as required by law. All taxes are sole responsibility of winner. Odds of winning depend on the number of valid entries received. Prize will be awarded if the number of eligible entries is equal to or greater than the number of prizes available.
3. DRAWING: The “Mow Less, Catch More BigFish” Exmark Summer Sweepstakes Winner will be selected in a random drawing held on or about Monday, September 1, 2008, from all valid entries received. The winner of the eXmark Sweepstakes will be contacted by email at the email provided on or about the week of Monday, September 1, 2008. At which time, after five (5) days, contact has not been made, prizes will be forfeited and an alternate winner will be randomly selected.
4. ELIGIBILITY: The “Mow Less, Catch More BigFish” Exmark Summer Sweepstakes is open only to legal residents of the 48 contiguous United States, who are 18 years of age or older. Employees of Pure Fishing, Inc., Berkley, and their agencies, parents, subsidiaries, affiliates, vendors, wholesalers, retailers, or members of their immediate families or households are not eligible to participate. Sweepstakes void where prohibited by law. Federal, state and local laws and regulations apply. Prize winners may be required to complete and return Affidavits of Eligibility/Publicity Releases and Travel Releases. Affidavits of Eligibility/Publicity Releases and Travel Releases must be returned within fourteen (14) days of notification or the Prize will be forfeited and an alternate winner will be randomly selected.
5. RELEASE OF LIABILITY & PUBLICITY: The “Mow Less, Catch More BigFish” Exmark Summer Sweepstakes Winner consents to the use of Winner’s name, photographs or likenesses for publicity or advertising purposes without further compensation, where permitted by law. All entrants release Pure Fishing, Inc. and Berkley, and each of their parents, affiliates, subsidiaries, officers, directors, shareholders, retailers, agents, employees and all others associated with the development and execution of this Competition from any and all liability with respect to, or in any way arising from, this Competition and/or acceptance or use of the prize, including liability for personal injury, damages, death or monetary loss.
